LIVERPOOL FOOTBALL CLUB (the "CLUB") HOME MATCH
TICKET CONDITIONS OF ISSUE
1. Issue of Home Match Ticket
1.1.The issue of a Home Match Ticket and subsequent access to the Ground is subject to the Terms & Conditions of Entry (as may be amended from time to time and which can be accessed via the Website or can be provided upon written request to the Club. The Terms & Conditions of Entry incorporate the Premier League’s Commitment Regarding Abusive and Discriminatory Conduct (the “Commitment”), which can be accessed via the Premier League’s website at https://www.premierleague.com/about/publications or provided by the Club following a written request, the Premier League Ground Regulations (which can be accessed via the Website) and the Selling Notice for the applicable Match (which can be accessed on the applicable ticket sales page on the Website). For the avoidance of doubt, in the event of a conflict between the different parts of the Terms & Conditions of Entry, they shall apply in the following order of precedence:
1.1.1.the rules and regulations of any Football Authority (including the Commitment);
1.1.2.the Selling Notice;
1.1.3.these Conditions of Issue; and
1.1.4.the Ground Regulations (where applicable).
1.2.Home Match Tickets are for the use of supporters of the Club only. By applying for the Home Match Ticket and/or using the same you hereby warrant and represent that you are a supporter of the Club and that you are not a supporter of the Away Club. Please note that you may be asked to provide photographic proof of identity at any point in the application process for Home Match Tickets and/or at any point during the Season. Failure to comply with such request and/or failure to complete such identification verification process may result in the cancellation of your Home Match Ticket(s) and a suspension from purchasing future Home Match Tickets.
2. Mobile Ticketing
2.1.Subject to clause 2.4 below, all Home Match Tickets will be issued as electronic mobile tickets using near-field communication technology, or such other technology as the Club may decide to use from time to time (each such ticket being an “E-Ticket”).
2.2.In order to use your Home Match Ticket, you will be required to download the E-Ticket to your mobile smartphone by following the instructions provided by the Club from time to time. E-Tickets are only compatible with iPhone 6 and above and most Android/Google phones. Confirmation of whether your device is compatible with E-Tickets can be provided by the Club’s ticket office upon request. It is your responsibility to download the relevant E-Ticket, and to ensure that it is displayed correctly on your mobile smartphone. In the event that you have problems with downloading your Home Match Ticket as an E-Ticket, you must immediately inform the Club’s ticket office in accordance with clause 2.4 below.
2.3.The Home Match Ticket will need to be displayed on your mobile smartphone as an E-Ticket in order to gain access to the Ground. Home Match Tickets that are not displayed correctly (for example, due to a defective mobile smartphone or insufficient battery) will be rejected and you may be refused entry. Where your admission is rejected and/or you are refused entry in such circumstances, no refund or other compensation will be due to you.
2.4.In the event that you do not hold a compatible mobile smartphone or you are unable to access your Home Match Ticket via a mobile smartphone device, you must immediately inform the Club’s tickets office and they will discuss alternative access options with you that may be available depending on the circumstances, such alternative access options always being subject to the Club’s sole discretion.
3. Admission to the Ground
3.1.By purchasing and/or using a Home Match Ticket to gain access to the Ground, you: (a) certify that you have read, understood and accepted the Terms & Conditions of Entry; (b) agree to be bound by and to comply with, the Terms & Conditions of Entry; and (c) agree to bring to the attention of others, as required below, the Terms & Conditions of Entry.
3.2.Subject to these Conditions of Issue, a Home Match Ticket permits you to occupy at the Match the seat indicated on the Home Match Ticket or such other alternative seat of equal price as the Club may allocate to you at its reasonable discretion or allocated to you as required by law and/or the relevant Football Authority. All access to the Ground pursuant to a Home Match Ticket shall be for the purposes of private enjoyment of the Match only and not for any commercial purpose (and no authorisation is given or implied in respect of the carrying out of any commercial activities).
3.3.Nothing in these Conditions of Issue shall constitute or imply any entitlement to occupy the seat indicated on the Home Match Ticket in any subsequent Match or season.
3.4.Save as set out in clause 3.5 below, you shall not capture, log, record, transmit, play, issue, show or otherwise communicate (by digital or other means) any Material in relation to the Match, any players or other persons present in the Ground and/or the Ground itself, nor may you bring into the Ground or use within the Ground (or provide to, facilitate or otherwise assist another person to use within the Ground) any equipment or technology which is capable of capturing, logging, recording, transmitting, playing, issuing, showing or otherwise communicating (by digital or other means) any such Material. Any person acting in breach of this provision may have such equipment or technology confiscated and/or will be required to deliver up any tapes, films, disks, memory cards, memory sticks or other recordings of the Material (and all copies thereof) in whatever form, to the applicable Football Authority and/or the Club. In addition, where you breach this paragraph 3.4, the Club reserves the right to: (a) eject you from the Ground; and/or (b) refer your account to the Sanctions Panel.
3.5.Mobile telephones and other mobile devices are permitted within the Ground, provided that (a) they are used for personal and private use only (which, for the avoidance of doubt and by way of example only, shall not include the capturing, logging, recording, transmitting, playing, issuing, showing, sharing or any other communication of any Material for any commercial purpose); and (b) no Material that is captured, logged, recorded, transmitted, played, issued, shown or otherwise communicated by a mobile telephone or other mobile device may be published or otherwise made available to any third parties including, without limitation, via social networking sites.
3.6.The copyright, database right and all other rights, title and interest in and to all Material that you produce at the Ground in relation to the Match, any players or other persons present in the Ground and/or the Ground itself (whether produced in breach of clause 3.4 above, or pursuant to clause 3.5 above, or otherwise) is hereby assigned to the appropriate Football Authority or the Club, including by way of present assignment of future copyright pursuant to section 91 of the Copyright, Designs and Patents Act 1988. You further agree (if and whenever required to do so by the appropriate Football Authority or the Club) to promptly execute all instruments and do all things necessary to vest the right, title and interest in such rights to the appropriate Football Authority or the Club absolutely and with full title guarantee.
3.7.Save for official Club merchandise and/or other football related clothing worn in good faith, you shall not bring into, use, wear or display within or around the Ground any sponsorship, promotional or marketing materials.
3.8.You shall not offer or distribute (either free or for sale by any person) within or around the Ground any consumer article or commercial product of any nature. For the avoidance of doubt this clause shall not prevent the lawful distribution of text publications in any format which do not infringe clause 3.4 where both the content and the publication are lawful in all respects and do not in the Club's reasonable opinion constitute a threat to public order.
3.9.The Club reserves the right to refuse admission to, or eject from, the Ground any person who fails to comply with the Terms & Conditions of Entry and in such circumstances no refund or alternative seat will be offered. For the avoidance of doubt, it is your sole responsibility to ensure that in advance of you attending a Match you have read, and comply at all times with, the Commitment and the Selling Notice (including, without limitation, any stadium policies in place from time to time).
3.10.Without prejudice to the representation at clause 1.2 above, any attempt to gain access to the areas of the Ground which are not allocated for Away Club supporters wearing or carrying apparel (including, without limitation, hats and/or scarves) that demonstrate support for the Away Club, may result in you being refused admission to, or being ejected from, the Ground. In such circumstances no refund or alternative seat will be offered to you, nor will any form of compensation or refund for missing part or all of the Match. Further, in such circumstances your case may be referred to the Sanctions Process, following which additional sanctions may be imposed against you.
3.11.Without prejudice to the representation at clause 3.9 above, in accordance with the Contract (Rights of Third Parties) Act 1999, any member club of the Premier League from time to time may enforce a breach of the Tragedy Chanting prohibition contained at paragraph 9 of the Ground Regulations relating to the banning of individuals from stadia and/or locations owned, occupied or utilised by any other member clubs of the Premier League from time to time who have engaged in Tragedy Chanting.
4.Use of Home Match Ticket
4.1.Subject to clause 4.3 below, the Home Match Ticket is issued for your sole use regardless of who makes payment for the Home Match Ticket, and you shall not resell, dispose of, assign, transfer, lend or otherwise deal with the Home Match Ticket or the benefit of it to any other. The reference to selling the Home Match Ticket includes: (a) offering to sell a Home Match Ticket (including, without limitation, via any website or online auction site); (b) exposing a Home Match Ticket for sale; (c) making a Home Match Ticket available for sale by another person; (d) advertising that a Home Match Ticket is available for purchase, which for the avoidance of doubt (and by way of example only) means that this Home Match Ticket may not be offered as a prize in any promotion or competition; (e) transferring, lending or selling a Home Match Ticket to any third party as part of a hospitality or travel package; and (f) giving (or offering to give) a Home Match Ticket to a person who pays or agrees to pay for some other goods or services (or offers to do so); all save as expressly authorised by the appropriate Football Authority or the Club.
4.2.The unauthorised sale or disposal of tickets is a criminal offence under section 166 of the Criminal Justice and Public Order Act 1994, as amended by the Violent Crime Reduction Act 2006, and the purchasing of tickets in a method which circumvents any ticket limit restrictions and which is done for the purpose of making financial gain is a criminal offence under The Breaching of Limits on Ticket Sales Regulations 2018. The Club will inform the police when it becomes aware that tickets are being sold illegally and will press for charges to be brought against those breaking this law. If you are convicted of a ticket touting offence, or we reasonably suspect you have committed such an offence, then: (a) you, and any and all applicable ticketing accounts (being an official membership, season ticket account etc.) will be subject to the Sanctions Process, following which the Club may impose sanctions against you/your account; (b) we will notify the appropriate Football Authority who may in turn notify other football clubs, event holders; and/or (c) we will notify the relevant law enforcement authorities. The information that we share may include, without limitation, your personal details, information about the offence and about ticket purchases (including payment details), the processing of which shall be in accordance with clause 13.2 and the Club’s current privacy policy from time to time.
4.3.In the event you are unable to attend a Match, you may only:
4.3.1.where applicable and made available by the Club, transfer a Home Match Ticket to a Guest using Ticket Distribution;
4.3.2.transfer a Home Match Ticket to a member of your “Friends & Family” (“Friends & Family”) via Ticket Forwarding or with the express written consent of the Club given at the Club’s absolute discretion; or
4.3.3.sell the Home Match Ticket to a third party via the Ticket Exchange.
4.4.For the avoidance of doubt, the Club may impose any restrictions within the Ticket Distribution, Ticket Forwarding and/or Ticket Exchange systems as its sees fit from time to time during the Season. In all cases the value of consideration you receive in relation to the Home Match Ticket shall not be in excess of the face value of a single ticket to that Match and such transfer shall not take place during the course of any business or for the purpose of facilitating any third party’s business. Such transfer to any Guest or member of Friends & Family in accordance with clause 4.3.1 or 4.3.2 (as appropriate) and the Guest’s or Friends & Family’s subsequent use of the ticket, is subject to the Terms & Conditions of Entry which will (save for any rights to transfer under this clause or any rights to a refund under clause 5.3) apply to and bind that Guest or member of Friends & Family as if he/she/they was the original purchaser of the Home Match Ticket (and you must inform the Guest or member of Friends & Family of this). You will provide the name and address of any Guest(s) when asked to do so by any Club official, steward, employee or any police or enforcement officer.
4.5.If more than one Home Match Ticket is issued to you, one Home Match Ticket must be retained by you for personal use (subject to the provisions above) and the remainder must be transferred and/or resold in accordance with clause 4.3 above.
4.6.The Home Match Ticket will remain the property of the Club at all times and must be produced by way of E-Ticket (or such other ticket as the Club may provide to you from time to time) together with photographic evidence of your identity if required to do so by any official, steward or employee of the Club or any police officer. The Club reserves the right to require the immediate return of the Home Match Ticket at any time.
4.7.Any Home Match Ticket distributed, obtained or used in breach of the Terms & Conditions of Entry shall be automatically void and all rights conferred or evidenced by such Home Match Ticket shall be nullified. Misuse of a Home Match Ticket may result in the holder being refused entry to, or ejected from, the Ground in respect of a particular Match, the cancellation and withdrawal of his/her/their Home Match Ticket(s) and/or the Club imposing sanctions against you (including restrictions regarding future purchase of tickets) in line with the Sanctions Process. In the event of any cancellation and withdrawal in accordance with this clause 4.7, no refund shall be payable. The Club further reserves its right to take any legal action against any persons as it sees fit in connection with such matters, including a claim for an account of profits made from an unauthorized use of the Home Match Ticket.
4.8.There shall be no upgrades from a child concessionary ticket to an adult ticket or a wheelchair ticket to a standard general admission ticket under any circumstances.
4.9.Selling your ticket via the Ticket Exchange will result in you losing any applicable match credit(s) associated with that Match in question. In addition, forwarding your ticket using Ticket Forwarding may result in you losing applicable match credit(s) associated with that Match. For more details please see the table below:

4.10.By purchasing a Home Match Ticket, you warrant that you intend to attend the relevant Match and that you are not purchasing such Home Match Ticket for the purpose of obtaining the relevant credit. Where the Club becomes aware or reasonably suspects that you have purchased a Home Match Ticket for a Match that you are unable to attend, or have no intention of attending, and such Home Match Ticket is not subsequently, distributed, forwarded or resold in line with the processes set out in this clause 4, the Club may, at its sole discretion, not issue you with a credit in respect of the relevant Home Match Ticket and/or remove previous credits from our ticketing account.
5. Changes to Dates, Refunds & Exchanges
5.1.No guarantees are given by the Club that the Match will take place at a particular time or on a particular date or played with fans in attendance or at full capacity. Subject to clause 5.2, below, the Club reserves the right to reschedule any Match without notice and without any liability whatsoever.
5.2.In the event of the postponement or abandonment of the Match (or if the Match has, for any reason, to be played out of view of the public or at a reduced capacity resulting in the cancellation of your Home Match Ticket), you will be entitled to receive the equivalent ticket for the subsequent re-arranged Match (where relevant) via such application procedure as the Club stipulates, or you will be entitled to receive a full refund (including any booking and/or administration fee). The Club will have no further liability whatsoever, including (but not limited to) any indirect or consequential loss or damage, loss of enjoyment or travel/accommodation costs.
5.3.In order to obtain a refund, the Home Match Ticket must be returned to the Club’s ticket office and the refund must be claimed by you ahead of the applicable deadline communicated by the Club. A refund will only be issued on production of photographic identification proving that the individual requesting the refund is the person to whom the Home Match Ticket was originally sold. For the avoidance of doubt, the final decision belongs to the Head of Ticketing at the Club at the relevant time.
5.4.Once a Home Match Ticket is purchased you shall not be entitled to cancel your Home Match Ticket and (except where expressly set out in the Terms & Conditions of Entry) no refunds shall be given by the Club for any Matches unattended.
6. Lost or Stolen Home Match Tickets
6.1.In order to gain admission to the Ground the Home Match Ticket must be presented in its entirety at the Match.
6.2.The Club shall not be obliged to admit you or issue any replacement for a lost, stolen or destroyed Home Match Ticket (including losing or no longer having access to the device on which your Home Match Ticket is stored in the form of an E-Ticket).
7.Cancellation & Withdrawal of Home Match Ticket
7.1.Without prejudice to the Club’s rights to cancel or withdraw a Home Match Ticket, the Club reserves the right to refuse admission to, or eject from, the Ground any person:
7.1.1.who fails to comply with any part of the Terms & Conditions of Entry (including, without limitation, any stadium policies which form part of these);
7.1.2.whose entry into the Ground is likely to, in the reasonable opinion of the Club, result in a failure to comply with the Terms & Conditions of Entry;
7.1.3.who is subject to a sanction imposed by the Club; or
7.1.4.who is prohibited (whether by law or otherwise) from attending any football ground (including the Ground) or is the subject of football related criminal or civil proceedings.
7.2.Without prejudice to any other remedies it may have, the Club shall have the right in the case of any breach, or action in contravention, of any part of the Terms & Conditions of Entry to cancel and withdraw any Home Match Ticket issued to you. In the event of such cancellation no refund will be paid and your conduct may be referred to the Sanctions Panel with a view to further sanctions being imposed against you. Without prejudice to the general nature of the above, the following actions constitute examples of a breach of the Terms & Conditions of Entry:
7.2.1.smoking, vaping or use of e-cigarettes in areas any part of the Ground;
7.2.2.being (or appearing to be) intoxicated;
7.2.3.persistent standing in seated areas whilst the Match is in progress (except where you have a ticket to a Licensed Standing in Seated Area pursuant to clause 10);
7.2.4.sale or transfer (save as permitted in these Conditions of Issue) of a Home Match Ticket to any person;
7.2.5.the possession of a banner or flag that bears material or slogans that are offensive, obscene, abusive or racist;
7.2.6.the deliberate misuse of a Home Match Ticket;
7.2.7.the supply of any misleading or incorrect information in any application made to the Club;
7.2.8.the throwing of any object within or around the Ground that may cause injury, damage, distress or annoyance to people or property without lawful authority or excuse;
7.2.9.whether at the Ground, or, travelling to or from a Match or at any event, occasion or location linked to the Club:
7.2.9.1.the use of foul, obscene, abusive, racist and/or discriminatory language and/or gestures; and/or
7.2.9.2.the chanting of anything of an indecent or racist and/or discriminatory nature; and/or
7.2.9.3.fighting or engaging in and/or inciting violence;
7.2.10.bringing into the Ground (or using within the Ground): illegal drugs, other illegal substances, fireworks, firecrackers, smoke canisters, air horns, flares, laser devices, bottles, glass vessels or any item that might be used as a weapon or compromise public safety;
7.2.11.entering the playing area or any adjacent area to which spectators are not generally admitted without lawful authority or excuse;
7.2.12.any misrepresentation in relation to clause 1.2;
7.2.13.breach of the terms of any Club membership (if so applicable);
7.2.14.any breach of clauses 3 or 4 above;
7.2.15.any failure to pay or default of payment in respect of any sums owing to the Club (or any third party) in respect of any Home Match Ticket;
7.2.16.use, or where the Club suspects use, of software that is designed to enable or facilitate completion of any part of the ticket purchasing process;
7.2.17.purchase, or attempted purchase, of tickets with a view, in the Club’s opinion, to any person obtaining financial gain;
7.2.18.any actual or suspected breach of The Breaching of Limits on Ticket Sales Regulations 2018;
7.2.19.any prohibited activity as defined in the Commitment or any other activity in contravention of the Commitment;
7.2.20.any failure to comply with any policies and/or procedures communicated by the Club within the Selling Notice; and
7.2.21.without prejudice to any of the foregoing, any other breach of the Ground Regulations.
7.2.22.Distribution of match tickets to an account that has supplied misleading or incorrect information, and/or distribution of match tickets to an account that has, in the Club’s opinion, failed to verify their identity and/or has supplied misleading or incorrect information.
7.3.The Club may conduct security searches where it has reason to believe that any of the breaches set down in this clause 7 have either occurred or may occur.
7.4.If a Home Match Ticket holder is not 16 years old or over, his/her parent(s) and/or guardian(s) are responsible for his/her actions, conduct and compliance with all aspects of the Terms & Conditions of Entry, and may also be subject to sanctions imposed by the Sanctions Panel in the event the Home Match Ticket holder does not comply with the Terms & Conditions of Entry.
7.5.In the event that your Home Match Ticket is withdrawn or cancelled and/or the Club imposes a sanction against you pursuant to the Sanctions Process, the Club reserves the right to:
7.5.1.exclude you from any membership scheme maintained or organised by the Club; and/or
7.5.2.to disqualify you from applying for any Match ticket or season ticket at its discretion; and/or
7.5.3.to notify any Football Authority and/or other football clubs of such exclusion, sanctions and/or disqualification (and the reason(s) for such exclusion, sanctions and/or disqualification).
8. Equality and Anti-Discrimination
8.1.The Club is committed to equality and diversity and it is important that all of our fans share the Club's principles of inclusion.
8.2.We require all Home Match Ticket holders to refrain from engaging in any conduct which is racist, homophobic or abusive and to refrain from any other discriminatory behaviour, including but not limited to discriminatory behaviour in relation to the following characteristics:
8.2.1.age;
8.2.2.disability;
8.2.3.gender reassignment;
8.2.4.marriage and civil partnership;
8.2.5.pregnancy and maternity;
8.2.6.race;
8.2.7.religion or belief;
8.2.8.sex; and
8.2.9.sexual orientation.
8.3.Home Match ticket holders who engage in any of the behaviours set out at clause 8.2 may (regardless of the medium in which such behaviour takes place and without prejudice to clauses 7.1 and 7.2 above):
8.3.1.be subject to actions taken in accordance with Club policies on anti-discrimination as stated on the Website (including the Commitment and the Sanction Process);
8.3.2.be refused entry to or evicted from the Ground;
8.3.3.have their Home Match Ticket and future Home Match tickets cancelled or withdrawn;
8.3.4.be suspended or banned from entering the Ground on future occasions and/or subject to any other sanctions imposed by the Club; and/or
8.3.5.be subject to prosecution in accordance with law.
9. Filming, photography and taping
9.1.All Home Match Ticket holders who enter the Ground acknowledge that photographic images and/or audio, visual and/or audio-visual recordings and/or feeds (and/or stills taken therefrom) may be taken of them and may also be used, by way of example and without limitation, in televised coverage of the Match and/or for promotional, training, editorial or marketing purposes by the Club, the appropriate Football Authority or others (including commercial partners and accredited media organisations), and use of a Home Match Ticket to enter the Ground constitutes consent to such use. You further acknowledge that photographic images and/or audio, visual and/or audio-visual recordings and/or feeds (and/or stills taken therefrom) may be used (by the Club or by a third party, such as a law enforcement body) to identify you as an individual, where permitted by data protection laws, for the purposes of preventing or detecting crime, or any breach of any part of the Terms & Conditions of Entry. Information about the Club's use of your personal data will be brought to your attention by the Club (see for example any applicable privacy policy, signage and/or other forms of announcement in or around the Ground). 9.2.All Home Match Ticket holders agree that the Matches for which Home Match Tickets have been purchased are public, and that their appearance and actions inside and in the perimeter of the Ground where a Match occurs are public in nature, and that they shall have no expectation of privacy with regard to their actions or conduct at Matches.
10.Licensed Standing in Seated Areas
10.1.The Club operates licensed standing in seated accommodation areas at the Ground as part of the UK Government’s scheme on safe standing in conjunction with the Sports Grounds Safety Authority (the “Licensed Standing in Seated Areas”). Only ticketholders who have tickets to the Licensed Standing in Seated Areas are permitted to access the Licensed Standing in Seated Areas. Ticket holders who have tickets to the Licensed Standing in Seated Areas shall:
10.1.1.occupy the space in front of the seat allocated to them on their ticket only and must not move to different spaces within the Licensed Standing in Seated Areas or to different areas of the Ground;
10.1.2.expect that other spectators will be standing while play is in progress (although, of course, they may sit on their allocated seat before and after the activity, or during an interval or halftime break);
10.1.3.not sit or stand on the rails, or stand on the seats in the Licensed Standing in Seated Areas;
10.1.4.not permitted to admit anyone who does not have a ticket to the Licensed Standing in Seated Areas to the Licensed Standing in Seated Areas;
10.1.5.be respectful towards staff, stewards, and other fans at all times;
10.1.6.behave appropriately in the Licensed Standing in Seated Area – anti-social behaviour will not be tolerated;
10.1.7.unless needing to use facilities, not move around in the Licensed Standing in Seated Areas and shall stay in the designated space only as described on the relevant ticket and in accordance with clause 10.1.1;
10.1.8.not be permitted to stand in the gangways or on the steps in the Licensed Standing in Seated Areas to watch the Match and acknowledges that these are for accessing and leaving seats only; and
10.1.9.acknowledge that any failure to comply with the conditions set out in this paragraph 10 may lead to ticketholders being ejected from the Ground, banned from all Matches and/or subject to any official sanctions imposed by the Club in line with the Sanctions Process, and the Ground may lose the right to maintain the Licensed Standing in Seated Areas.
11. Exclusion of Liability
11.1.Except in respect of death or personal injury resulting from any negligence of the Club, neither the Club nor any of its officers, employees or agents shall be responsible for (whether in tort, contract or otherwise):
11.1.1.any loss, damage or injury to you and/or any Guest or to any property belonging to you or any Guest in or upon or around the Ground or any car park, resulting from any cause whatsoever;
11.1.2.any loss of profit, loss of use, loss of opportunity or any indirect, economic or consequential losses whatsoever; or
11.1.3.any losses arising from any cancellation, postponement or rearrangement of a Match including but not being limited to any indirect or consequential loss or damage, loss of enjoyment or travel/accommodation costs.
11.2.Neither the appropriate Football Authority nor the Club shall be responsible for any interruptions and/or restrictions to the view of the Match caused by virtue of:
11.2.1.the position of the seat; or
11.2.2.the actions of other spectators.
12. Governing Law
These Conditions of Issue shall be governed by and construed in accordance with the laws of England and Wales. The parties hereby submit to the exclusive jurisdiction of the Courts of England and Wales (including in relation to any non-contractual disputes or claims).
13. Miscellaneous
13.1.The Club reserves the right to change these Conditions of Issue from time to time and shall publicise such changes on the Website.
13.2.You acknowledge that the Club will hold and process data relating to you, which may include personal data, for administrative and legal purposes. The personal data that you provide to the Club shall be processed, stored and transferred in accordance with the terms of the Club's current privacy policy. In particular, we may share your personal data, including your name, date of birth, photograph, contact details and information about ticket purchases (including payment details and the names of ticket holders) with other football clubs, any Football Authority and with law enforcement authorities. This data will be shared with such parties where the Club deems it is necessary, including (without limitation) for the purpose of identifying and preventing violent and antisocial behaviour at matches, including racial, homophobic or discriminatory abuse, chanting or harassment, identifying and preventing ticket touting offences and for the purpose of enforcing sanctions imposed by the Club, another football club, any Football Authority or any law enforcement authorities. We may also share your data in order to support with the handling of fan enquiries and to allow for rapid identification of fans in the event of incidents including health emergencies and general crowd control emergencies.
13.3.Whilst at the Ground your personal data may be collected by other parties including the appropriate Football Authority. Such third parties should provide you with details on how and why your personal data will be processed and/or a copy of their privacy notice.
13.4.The invalidity or partial invalidity of any provision of these Conditions of Issue shall not prejudice or affect the remainder of these Conditions of Issue, which shall continue in full force and effect. If any invalid, unenforceable or illegal provision of this agreement would be valid, enforceable and legal if some part of it were deleted, the provision shall apply with the minimum modification necessary to make it legal, valid and enforceable.
13.5.The Club’s failure to exercise, or delay in exercising, any right, power or remedy provided by these Conditions of Issue or by law shall not constitute a waiver of that right, power or remedy.
13.6.The Terms & Conditions of Entry constitute the entire agreement between the Club and the Home Match Ticket holder in respect of the Home Match Ticket, and neither the Club nor the Home Match Ticket holder shall have any claim or remedy in respect of any statement, representation, warranty or undertaking made by or on behalf of any other party in relation to the Terms & Conditions of Entry which is not set out therein.
13.7.Notwithstanding any other provision in these Conditions of Issue and with the exception of any Football Authority, no other person other than you or the Club has any rights under the Contracts (Rights of Third Parties) Act 1999 to rely on or enforce any term of these Conditions of Issue. Nothing in these terms of conditions shall affect any right or remedy of a third party that exists or is available other than as a result of the aforementioned Act.
14. Definitions
In these Conditions of Issue the following words and phrases shall have the following meanings:
“Away Club”means the football club playing against the Club;
“Club”means The Liverpool Football Club and Athletic Grounds Limited;
"Conditions of Issue" means these terms and conditions governing the issue and use of a Home Match Ticket;
“Commitment”has the meaning provided at clause 1.1;
“E-Ticket” has the meaning provided at clause 2.1;
“Football Authority”means each of the Premier League, The Football League, The Football Association, The Football Association of Wales, FIFA, UEFA and other relevant governing body of association football;
“Friends & Family” means the list of friends and family members (a maximum of 6 members) set out in the home page of your ticketing account and to whom you may forward tickets via Ticket Forwarding;
"Ground" means the football stadium “Anfield” and all other locations owned, occupied or utilised by the Club;
"Ground Regulations" means those ground regulations issued by the Club from time to time that set out the terms and conditions upon which spectators are granted entry to the Ground, located on the Website;
"Guest" means a relative, friend, colleague and/or companion to the disabled who would be entitled to purchase a Home Match Ticket under the Terms & Conditions of Entry and each of whom is known to the Home Match Ticket holder;
"Home Match Ticket"means your E-Ticket or other form of ticket (and/or any rights arising out of or in connection with the foregoing) for admission to a Match;
"Match" means any home football match in which the Club participates and that takes place at the Ground during the Season as designated upon the ticket to which these Conditions of Issue apply;
“Material”means any audio, visual or audio-visual material or any information or data;
“Sanctions Panel” means the panel of Club personnel who manage the Sanctions Process;
“Sanctions Process” means the Club’s official sanctions process, with details of the process and the sanctions which the Club may impose being set out here: www.liverpoolfc.com/corporate/official-sanctions-process ;
"Season” means the 2023/2024 football season;
"Selling Notice” means the selling notice located on the ticket sales page for the relevant Match setting out details relating to the purchase of a ticket for, and attendance at, a specific Match (including, without limitation, the ticket price, ticket fulfilment mechanism, eligibility criteria for tickets, stadium policies and/or requirements);
"Terms & Conditions of Entry" means each of the rules and regulations of any Football Authority (including the Commitment), the Ground Regulations, these Conditions of Issue, and the Selling Notice;
“Ticket Distribution” means the Club’s ticket distribution process whereby eligible supporters can distribute tickets to third parties (such person being a Guest for the purposes of these Conditions of Issue);
"Ticket Exchange" means the Club's authorised ticket resale facility in place from time to time;
“Ticket Forwarding” means the Club’s authorised ticket forwarding functionality, via which you may forward a ticket to a member of your Friends & Family;
"Tragedy Chanting” as defined in the Ground Regulations; and
“Website” means the Club’s website, currently www.liverpoolfc.com.
LIVERPOOL FOOTBALL CLUB (the "CLUB") AWAY MATCH
TICKET CONDITIONS OF ISSUE
1. Issue of Away Match Ticket
14.1.The issue of an Away Match Ticket and subsequent access to the Ground is subject to the Terms & Conditions of Entry (as may be amended from time to time and which can be accessed via the Website or can be provided upon written request to the Club. The Terms & Conditions of Entry incorporate the Premier League’s Commitment Regarding Abusive and Discriminatory Conduct (the “Commitment”), which can be accessed via the Premier League’s website at https://www.premierleague.com/about/publications or provided by the Club following a written request, the Premier League Ground Regulations (which can be accessed via the Website) and the Selling Notice for the applicable Match (which can be accessed on the applicable ticket sales page on the Website). For the avoidance of doubt, in the event of a conflict between the different parts of the Terms & Conditions of Entry, they shall apply in the following order of precedence:
1.1.1.the rules and regulations of any Football Authority (including the Commitment);
1.1.2.the Selling Notice;
1.1.3.these Conditions of Issue; and
1.1.4.the Ground Regulations (where applicable).
1.2.Away Match Tickets are for the use of Club supporters attending an Away Match only. By applying for the Away Match Ticket and/or using the same you hereby warrant and represent that you are a supporter of the Club and/or that you are not a supporter of the Host Club.
2. Admission to the Ground
2.1.By purchasing and/or using of the Away Match Ticket to gain access to the Away Ground, you: (a) certify that you have read, understood and accepted the Terms & Conditions of Entry; (b) agree to be bound by and to comply with the Terms & Conditions of Entry; and (c) agree to bring to the attention of others, as required below, all parts of the Terms & Conditions of Entry.
2.2.Subject to these Conditions of Issue, an Away Match Ticket permits you to occupy at the Away Match the seat indicated on the Away Match Ticket or such other alternative seat of equal price as the Club or the Host Club may allocate to you at its reasonable discretion, or if required by law or the relevant Football Authority. All access to the Away Ground pursuant to an Away Match Ticket shall be for the purposes of private enjoyment of the Away Match only and not for any commercial purpose (and no authorisation is given or implied in respect of the carrying out of any commercial activities).
2.3.Nothing in these Conditions of Issue shall constitute or imply any entitlement to occupy the seat indicated on the Away Match Ticket in any subsequent match at the relevant Away Ground.
2.4.Save as set out in clause 2.5 below, you shall not capture, log, record, transmit, play, issue, show or otherwise communicate (by digital or other means) any Material in relation to the Away Match, any players or other persons present in the Away Ground and/or the Away Ground itself, nor may you bring into the Away Ground or use within the Away Ground (or provide to, facilitate or otherwise assist another person to use within the Away Ground) any equipment or technology which is capable of capturing, logging, recording, transmitting, playing, issuing, showing or otherwise communicating (by digital or other means) any such Material. Any person acting in breach of this provision may have such equipment or technology confiscated and/or will be required to deliver up any tapes, films, disks, memory cards, memory sticks or other recordings of the Material (and all copies thereof) in whatever form, to the appropriate Football Authority, the Host Club and/or the Club. In addition, where you breach this paragraph 2.4, the Club reserves the right to refer your account to the Sanctions Panel, who may ban you from purchasing tickets for and attending future Away Matches.
2.5.Mobile telephones and other mobile devices are permitted within the Away Ground, provided that (a) they are used for personal and private use only (which, for the avoidance of doubt and by way of example only, shall not include the capturing, logging, recording, transmitting, playing, issuing, showing or any other communication of any Material for any commercial purposes); and (b) no Material that is captured, logged, recorded, transmitted, played, issued, shown or otherwise communicated by a mobile telephone or other mobile device may be published or otherwise made available to any third parties including, without limitation, via social networking sites.
2.6.The copyright, database right and all other rights, title and interest in and to all Material that you produce at the Away Ground in relation to the Away Match, any players or other persons present in the Away Ground and/or the Away Ground itself (whether produced in breach of clause 2.4 above, or pursuant to clause 2.5 above, or otherwise) is hereby assigned to the appropriate Football Authority, the Club or the Host Club, including by way of present assignment of future copyright pursuant to section 91 of the Copyright, Designs and Patents Act 1988. You further agree (if and whenever required to do so by the appropriate Football Authority) to promptly execute all instruments and do all things necessary to vest the right, title and interest in such rights to the appropriate Football Authority, the Club or the Host Club absolutely and with full title guarantee.
2.7.Save for official Club merchandise and/or other football related clothing worn in good faith, you shall not bring into, use, wear or display within, or around, the Away Ground any sponsorship, promotional or marketing materials.
2.8.You shall not offer or distribute (either free or for sale by any person) within or around the Away Ground any consumer article or commercial product of any nature. For the avoidance of doubt this clause shall not prevent the lawful distribution of text publications in any format which do not infringe clause 2.4 where both the content and the publication are lawful in all respects and do not in the Club's reasonable opinion constitute a threat to public order.
2.9.The Club and/or the Host Club reserves the right to refuse admission to, or eject from, the Ground any person who fails to comply with the Terms & Conditions of Entry and in such circumstances no refund or alternative seat will be offered. For the avoidance of doubt, it is your sole responsibility to ensure that in advance of you attending an Away Match you have read, and will at all times during the Away Match comply with, the Commitment and the Selling Notice (including, without limitation, any stadium policies in place from time to time).
2.10.Any attempt to gain access to the area of the Away Ground allocated for the Club wearing or carrying apparel (including, without limitation, hats and/or scarves) that demonstrate support for the Host Club, may result in you being refused admission to, or being ejected from, the Away Ground, you being banned from visiting the Away Ground in future and/or the Club imposing sanctions on you/your ticketing accounts. Further, for the avoidance of doubt, and in such circumstances no refund or alternative seat will be offered to you.
2.11.Without prejudice to the representation at clause 2.9 above, in accordance with the Contract (Rights of Third Parties) Act 1999, any member club of the Premier League from time to time may enforce a breach of the Tragedy Chanting prohibition contained at paragraph 9 of the Ground Regulations relating to the banning of individuals from stadia and/or locations owned, occupied or utilised by any other member clubs of the Premier League from time to time who have engaged in Tragedy Chanting.
2.12.Away Match Tickets may be issued by virtue of electronic mobile tickets using near-field communication technology, or such other technology as the Club or Host Club may decide to use from time to time (each such ticket being an “E-Ticket”).
2.13.If the Club and/or Host Club issues you an E-Ticket then in order to use your Away Match Ticket, you will be required to download the E-Ticket to your mobile smartphone by following the instructions provided by the Club or the Host Club from time to time. E-Tickets are only compatible with iPhone 6 and above and most Android/Google phones. Confirmation of whether your device is compatible with E-Tickets can be provided by the Club upon request. It is your responsibility to download the relevant E-Ticket, and to ensure that it is displayed correctly on your mobile smartphone. In the event that you have problems with downloading your Away Match Ticket as an E-Ticket, you must immediately inform the Club’s ticket office.
2.14.If the Club or Host Club issues you an E-Ticket, the Away Match Ticket will need to be displayed on your mobile smartphone as an E-Ticket in order to gain access to the Ground. Away Match Tickets that are not displayed correctly (for example, due to a defective mobile smartphone or insufficient battery) will be rejected and you may be refused entry. Where your admission is rejected and/or you are refused entry in such circumstances, no refund or other compensation will be due to you.
3. Use of Away Match Ticket
3.1.The Away Match Ticket is issued for your sole use and you shall not sell, dispose of, assign, transfer, lend or otherwise deal with the Away Match Ticket or the benefit of it to any other person without the prior written consent of the Club. The reference to selling the Away Match Ticket includes: (a) offering to sell an Away Match Ticket (including, without limitation, via any website or online auction site); (b) exposing an Away Match Ticket for sale; (c) making an Away Match Ticket available for sale by another person; (d) advertising that an Away Match Ticket is available for purchase, which for the avoidance of doubt (and by way of example only) means that this Away Match Ticket may not be offered as a prize in any promotion or competition; (e) transferring, lending or selling an Away Match Ticket to any third party as part of a hospitality or travel package; and (f) giving (or offering to give) an Away Match Ticket to a person who pays or agrees to pay for some other goods or services (or offers to do so); all save as expressly authorised by the appropriate Football Authority or the Club.
3.2.The unauthorised sale or disposal of tickets is a criminal offence under section 166 of the Criminal Justice and Public Order Act 1994, as amended by the Violent Crime Reduction Act 2006 and the purchasing of tickets in a method which circumvents any ticket limit restrictions and which is done for the purpose of a personal making financial gain is a criminal offence under The Breaching of Limits on Ticket Sales Regulations 2018. The Club may inform the police and the Host Club when it becomes aware that tickets are being sold illegally and will press for charges to be brought against those breaking this law. If you are convicted of a ticket touting offence, or we reasonably suspect you have committed such an offence, then: (a) you, and any and all applicable ticketing accounts (being an official membership, season ticket account etc.) will be subject to the Sanctions Process, following which the Club may impose sanctions against you/your account; (b) we will notify the appropriate Football Authority who may in turn notify other football clubs, event holders; and/or (c) we will notify the relevant law enforcement authorities. The information that we share may include, without limitation, your personal details, information about the offence and about ticket purchases (including payment details), the processing of which shall be in accordance with clause 12.2 and the Club’s current privacy policy from time to time.
3.3.The Away Match Ticket will remain the property of the Club at all times and must be produced together with photographic evidence of your identity if required to do so by any official, steward or employee of the Club or any police officer. The Club reserves the right to require the immediate return of the Away Match Ticket at any time.
3.4.Any Away Match Ticket distributed, obtained or used in breach of the Terms & Conditions of Entry shall be automatically void and all rights conferred or evidenced by such Away Match Ticket shall be nullified. Misuse of an Away Match Ticket may result in the holder being refused entry to, or ejected from, the Away Ground in respect of a particular Away Match, the cancellation and withdrawal of his/her/their Away Match Ticket and/or the Club imposing sanctions against you (including restrictions regarding future purchase of tickets) in line with the Sanctions Process. In the event of any cancellation and withdrawal in accordance with this clause 3.4, no refund shall be payable. The Club and the Host Club further reserves its right to take any legal action against any persons as it sees fit in connection with such matters, including a claim for an account of profits made from an unauthorized use of the Away Match Ticket.
3.5.There shall be no upgrades from a child concessionary ticket to an adult ticket or a wheelchair ticket to a standard general admission ticket under any circumstances.
4. Changes to Away Match Dates & Refunds
4.1.No guarantees are given by the Club or the Host Club that the Away Match will take place at a particular time or on a particular date or played with fans in attendance or at full capacity. Subject to clause 4.2 below, the Club and the Host Club reserves the right to reschedule any Match without notice and without any liability whatsoever.
4.2.In the event of the postponement or abandonment of the Away Match (or if the Match has, for any reason, to be played out of view of the public or at reduced capacity resulting in the cancellation of your Away Match Ticket), you will be entitled to receive the equivalent ticket for the subsequent re-arranged Away Match (where relevant) via such application procedure as the Club stipulates, or you will be entitled to receive a full refund (including any booking and/or administration fee). The Club will have no further liability whatsoever, including (but not limited to) any indirect or consequential loss or damage, loss of enjoyment or travel/accommodation costs.
4.3.Where a refund is available, in order to obtain any refund the Away Match Ticket must be returned to the Club’s ticket office ahead of the deadline communicated by the Club. A refund will only be issued on production of photographic identification proving that the individual requesting the refund is the person to whom the Away Match Ticket was originally sold. For the avoidance of doubt, the final decision belongs to the Head of Ticketing at the Club at the relevant time.
4.4.For the avoidance of doubt, your entitlement a refund in the event of an Away Match being cancelled is subject to the Club receiving a refund from the Host Club of the entire sums the Club paid for the away ticket allocation.
4.5.Once an Away Match Ticket is purchased you shall not be entitled to cancel your Away Match Ticket and (except where expressly set out in the Terms & Conditions of Entry) no refunds shall be given by the Club for any Away Matches unattended.
5. Lost or Stolen Away Match Tickets
5.1.In order to gain admission to the Away Ground the Away Match Ticket must be presented in its entirety at the Away Match.
5.2.The Club or the Host Club shall not be obliged to issue any replacement for a lost, stolen or destroyed Away Match Ticket (including losing or no longer having access to the device on which your Away Match Ticket is stored in the form of an E-Ticket).
6. Cancellation & Withdrawal of Away Match Ticket
6.1.Without prejudice to the Club’s rights to cancel or withdraw an Away Match Ticket, the Club reserves the right to cancel the tickets of, or authorised the Host Club to eject from the Away Ground, any person:
6.1.1.who fails to comply with the Terms & Conditions of Entry, including for the avoidance of doubt the Commitment and any information set out in the Selling Notice (including, without limitation, any stadium policies);
6.1.2.whose entry into the Away Ground is likely to, in the reasonable opinion of the Club or the Host Club, result in a failure to comply with the Terms & Conditions of Entry;
6.1.3.who is subject to a sanction imposed by the Club; or
6.1.4.who is prohibited (whether by law or otherwise) from attending any football ground (including the Away Ground) or is the subject of football related criminal or civil proceedings.
6.2.Without prejudice to any other remedies it may have, the Club shall have the right in the case of any breach of the Terms & Conditions of Entry and/or any activity in contravention of the Commitment or any element of the Selling Notice to cancel and withdraw any Away Match Ticket issued to you. In the event of such cancellation no refund will be paid and your conduct may be presented to the Sanctions Panel with a view to sanctions being imposed against you as part of the Sanctions Process. Without prejudice to the general nature of the above the following actions constitute examples of a breach of the Terms & Conditions of Entry:
6.2.1.smoking, vaping or using e-cigarettes in areas any part of the Away Ground;
6.2.2.being (or appearing to be) intoxicated;
6.2.3.persistent standing in seated areas whilst the Away Match is in progress (except where you have a ticket to a Licensed Standing in Seated Area pursuant to clause 10);
6.2.4.sale or transfer (save as permitted in these Conditions of Issue) of an Away Match Ticket to any person;
6.2.5.the possession of a banner or flag that bears material or slogans that are offensive, obscene, abusive or racist;
6.2.6.the deliberate misuse of an Away Match Ticket;
6.2.7.the supply of any misleading or incorrect information in any application made to the Club;
6.2.8.the throwing of any object within or around the Away Ground that may cause injury, damage, distress or annoyance to people or property without lawful authority or excuse;
6.2.9.whether at the Away Ground, or, travelling to or from an Away Match or at any event, occasion or location linked to the Club:
6.2.9.1.the use of foul, obscene, abusive, racist and/or discriminatory language and/or gestures; and/or
6.2.9.2.the chanting of anything of an indecent or racist and/or discriminatory nature; and/or
6.2.9.3.fighting or engaging in and/or inciting violence;
6.2.10.bringing into the Away Ground (or using within the Away Ground): illegal drugs, other illegal substances, fireworks, firecrackers, smoke canisters, air horns, flares, laser devices, bottles, glass vessels or any item that might be used as a weapon or compromise public safety;
6.2.11.entering the playing area or any adjacent area to which spectators are not generally admitted without lawful authority or excuse;
6.2.12.any misrepresentation in relation to clause 1.2;
6.2.13.breach of the terms of any Club membership (if so applicable);
6.2.14.any breach of clauses 2 or 3 above;
6.2.15.any failure to pay or default of payment in respect of any sums owing to the Club (or any third party) in respect of any Away Match Ticket;
6.2.16.use, or where the Club suspects use, of software that is designed to enable or facilitate completion of any part of the ticket purchasing process;
6.2.17.purchase, or attempted purchase, of tickets with a view, in the Club’s opinion, to any person obtaining financial gain;
6.2.18.any actual or suspected breach of The Breaching of Limits on Ticket Sales Regulations 2018; and
6.2.19.any prohibited activity as defined in the Commitment or any other activity in contravention of the Commitment.
6.3.Where applicable, the Club may conduct security searches where it has reason to believe that any of the breaches set down in this clause 6 have either occurred or may occur.
6.4.If an Away Match Ticket holder is not 16 years old or over, his/her parent(s) and/or guardian(s) are responsible for his/her actions, conduct and compliance with all parts of the Terms & Conditions of Entry (, and may also be subject to sanctions imposed by the Sanctions Panel in the event the Away Match Ticket holder does not comply with any part of the Terms & Conditions of Entry.
6.5.In the event that your Away Match Ticket is withdrawn or cancelled and/or the Club imposes a sanction against you pursuant to the Sanctions Process, the Club reserves the right to:
6.5.1.exclude you from any membership scheme maintained or organised by the Club; and/or
6.5.2.to disqualify you from applying for any Club tickets or season ticket at its discretion; and/or
6.5.3.any Football Authority and/or other football clubs of such exclusion, sanctions and/or disqualification (and the reason(s) for such exclusion, sanctions and/or disqualification).
7. Equality and Anti-Discrimination
7.1.The Club is committed to equality and diversity and it is important that all of our fans share the Club's principles of inclusion.
7.2.We require all Away Match Ticket holders to refrain from engaging in any conduct which is racist, homophobic or abusive and to refrain from any other discriminatory behaviour, including but not limited to discriminatory behaviour in relation to the following characteristics:
7.2.1.age;
7.2.2.disability;
7.2.3.gender reassignment;
7.2.4.marriage and civil partnership;
7.2.5.pregnancy and maternity;
7.2.6.race;
7.2.7.religion or belief
7.2.8.sex; and
7.2.9.sexual orientation.
7.3.Away Match ticket holders who engage in any of the behaviours set out at clause 7.2 may (regardless of the medium in which such behaviour takes place and without prejudice to clauses 6.1 and 6.2 above):
7.3.1.be subject to actions taken in accordance with Club policies on anti-discrimination as stated on the Website, including the Commitment;
7.3.2.be refused entry to or evicted from the Away Ground;
7.3.3.have their Away Match Ticket and future tickets cancelled or withdrawn;
7.3.4.be suspended or banned from entering the Away Ground and Anfield on future occasions; and/or
7.3.5.be subject to prosecution in accordance with law.
8. Filming, photography and taping
8.1.All Away Match Ticket holders who enter the Away Ground acknowledge that photographic images and/or audio, visual and/or audio-visual recordings and/or feeds (and/or stills taken therefrom) may be taken of them and may also be used, by way of example and without limitation, in televised coverage of the game and/or for promotional, training, editorial or marketing purposes by the Club, the Host Club any Football Authority, or others (including commercial partners and accredited media organisations), and use of an Away Match Ticket to enter the Away Ground constitutes consent to such use. You further acknowledge that photographic images and/or audio, visual and/or audio-visual recordings and/or feeds (and/or stills taken therefrom) may be used (by the Club or by a third party, such as a law enforcement body or the Host Club) to identify you as an individual, where permitted by data protection laws, for the purposes of preventing or detecting crime, or any breach of these Conditions of Issue or the Terms & Conditions of Entry. Information about the Club's use of your personal data will be brought to your attention by the Club (see for example any applicable privacy policy, signage and/or other forms of announcement in or around the ground). For further information please contact the Club.
8.2.All Away Match Ticket holders agree that the Away Matches for which Away Match Tickets have been purchased are public, and that their appearance and actions inside and in the perimeter of the Away Ground where an Away Match occurs are public in nature, and that they shall have no expectation of privacy with regards to their actions or conduct at Away Matches.
9.Licensed Standing in Seated Areas
9.1.Where the Host Club operates licensed standing in seated accommodation areas at the Away Ground as part of the UK Government’s scheme on safe standing in conjunction with the Sports Grounds Safety Authority (the “Licensed Standing in Seated Areas”), only ticketholders who have tickets to the Licensed Standing in Seated Areas are permitted to access the Licensed Standing in Seated Areas. Ticket holders who have tickets to the Licensed Standing in Seated Areas shall:
9.1.1.occupy the space in front of the seat allocated to them on their ticket only and must not move to different spaces within the Licensed Standing in Seated Areas or to different areas of the Away Ground;
9.1.2.expect that other spectators will be standing while play is in progress (although of course they may sit on their allocated seat before and after the activity, or during an interval or halftime break);
9.1.3.not sit or stand on the rails, or stand on the seats in the Licensed Standing in Seated Areas;
9.1.4.not permitted to admit anyone who does not have a ticket to the Licensed Standing in Seated Areas to the Licensed Standing in Seated Areas;
9.1.5.be respectful towards staff, stewards, and other fans at all times;
9.1.6.behave appropriately in the Licensed Standing in Seated Area – anti-social behaviour will not be tolerated;
9.1.7.unless needing to use facilities, not move around in the Licensed Standing in Seated Areas and shall stay in the designated space only as described on the relevant ticket and in accordance with clause 9.1.1;
9.1.8.not be permitted to stand in the gangways or on the steps in the Licensed Standing in Seated Areas to watch the Away Match and acknowledges that these are for accessing and leaving seats only; and
9.1.9.acknowledge that any failure to comply with the conditions set out in this clause 9 may lead to ticketholders being ejected from the Away Ground, banned from all matches and/or subject to any official sanctions imposed by the Club in line with the Sanctions Process.
10. Exclusion of Liability
10.1.Except in respect of death or personal injury resulting from any negligence of the Club, neither the Club nor any of its officers, employees or agents shall be responsible for (whether in tort, contract or otherwise):
10.1.1.any loss, damage or injury to you or to any property belonging to you in or upon or around the Away Ground or any car park, resulting from any cause whatsoever;
10.1.2.for any loss of profit, loss of use, loss of opportunity or any indirect, economic or consequential losses whatsoever; or
10.1.3.any losses arising from any cancellation, postponement or rearrangement of an Away Match in accordance with Clause 3 including but not being limited to any indirect or consequential loss or damage, loss of enjoyment or travel/accommodation costs.
10.2.Neither the appropriate Football Authority, the Host Club or the Club shall be responsible for any interruptions and/or restrictions to the view of the Away Match caused by virtue of
10.2.1.the position of the seat; or
10.2.2.the actions of other spectators.
11. Governing Law
These Conditions of Issue shall be governed by and construed in accordance with the laws of England and Wales. The parties hereby submit to the exclusive jurisdiction of the Courts of England and Wales (including in relation to any non-contractual disputes or claims).
12. Miscellaneous
12.1.The Club reserves the right to change these Conditions of Issue from time to time and shall publish any such changes on the Website.
12.2.You acknowledge that the Club will hold and process data relating to you, which may include personal data, for administrative and legal purposes. The personal data that you provide to the Club shall be processed, stored and transferred in accordance with the terms of the Club's current privacy policy . In particular, we may share your personal data, including your name, date of birth, photograph, contact details and information about ticket purchases (including payment details and the names of ticket holders) with other football clubs, any Football Authority and with law enforcement authorities. This data will be shared with such parties where the Club deems it is necessary, including (without limitation)for the purpose of identifying and preventing violent and antisocial behaviour at matches, including racial, homophobic or discriminatory abuse, chanting or harassment, for the purpose of identifying and preventing ticket touting offences and for the purpose of enforcing sanctions imposed by the Club, another football club, any Football Authority or any law enforcement authorities under the Commitment. We may also share your data in order to support with the handling of fan enquiries and to allow for rapid identification of fans in the event of incidents including health emergencies and general crowd control emergencies.
12.3.Whilst at the Away Ground your personal data may be collected by other parties including the appropriate Football Authority and/or the Host Club. Such third parties should provide you with details on how and why your personal data will be processed and/or a copy of their privacy notice.
12.4.The invalidity or partial invalidity of any provision of these Conditions of Issue shall not prejudice or affect the remainder of these Conditions of Issue, which shall continue in full force and effect. If any invalid, unenforceable or illegal provision of this agreement would be valid, enforceable and legal if some part of it were deleted, the provision shall apply with the minimum modification necessary to make it legal, valid and enforceable.
12.5.The Club’s failure to exercise, or delay in exercising, any right, power or remedy provided by these Conditions of Issue or by law shall not constitute a waiver of that right, power or remedy.
12.6.The Terms & Conditions of Entry constitute the entire agreement between the Club and the Away Match Ticket holder and neither the Club nor the Away Match Ticket holder shall have any claim or remedy in respect of any statement, representation, warranty or undertaking made by or on behalf of any other party in relation to any part of the Terms & Conditions of Entry which is not set out therein.
12.7.Notwithstanding any other provision in these Conditions of Issue and with the exception of any Football Authority, no other person other than you or the Club has any rights under the Contracts (Rights of Third Parties) Act 1999 to rely on or enforce any term of these Conditions of Issue. Nothing in these terms of conditions shall affect any right or remedy of a third party that exists or is available other than as a result of the aforementioned Act.
13. Definitions
In these Conditions of Issue the following words and phrases shall have the following meanings:
"Away Match" means a football match in which the Club participates and that takes place at a relevant Away Ground (and not, for the avoidance of doubt, at the football stadium of the Club during the Season), as designated upon the ticket to which these Conditions of Issue apply;
"Away Ground" means, with respect to the Away Match to which these Conditions of Issue apply, the football ground of the Host Club;
"Away Match Ticket" means a printed paper ticket or an E-Ticket (and/or any rights arising out of or in connection with any of the foregoing) for admission to the Away Match;
“Commitment”has the meaning provided at clause 1.1;
"Conditions of Issue" means these terms and conditions governing the issue and use of an Away Match Ticket;
“E-Ticket”has the meaning provided at clause 2.12;
“Football Authority”means each of the Premier League, The Football League, The Football Association, FIFA, UEFA and other relevant governing body of association football;
"Ground Regulations" means those ground regulations issued by the Host Club from time to time that set out the terms and conditions upon which spectators are granted entry to the Away Ground located on the Host Club’s website;
"Host Club" means the football club playing against the Club and whose stadium is the Away Ground at which the Away Match is being staged;
“Material” means any audio, visual or audio-visual material or any information or data;
"Season” means the 2023/2024 football season;
"Selling Notice” means the details in relation to the purchase of a ticket for, and attendance at, a specific Match (including, without limitation, the ticket price, ticket fulfilment mechanism, eligibility criteria for tickets, stadium policies and/or requirements), such details as set out in the “selling notice” published by the Club on its website on the sales page for the applicable Match;
"Terms & Conditions of Entry" means each of the rules and regulations of any Football Authority (including the Commitment), the Ground Regulations, the Selling Notice and these Conditions of Issue;
"Tragedy Chanting” as defined in the Ground Regulations; and
“Website” means the Club’s website, currently www.liverpoolfc.com.
